Lakso Terms of Use (End User License Agreement)

These Terms are an agreement between you and Silsoft Studio AS, a company registered in Norway (organisation number 930 277 770) ("Silsoft Studio", "we", "us"), about your use of the Lakso app for iPhone, Apple Watch and related widgets and shortcuts ("Lakso" or "the app"). By downloading, installing or using Lakso you agree to these Terms. If you do not agree, do not use the app.

1. Apple's Standard EULA and these Terms

Lakso is licensed, not sold, through the Apple App Store. These Terms supplement Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), which also applies to your use of the app. If the two conflict, Apple's standard EULA governs the points it covers, and these Terms govern the rest.

You and Silsoft Studio acknowledge that this agreement is between you and Silsoft Studio only, not Apple. Silsoft Studio, not Apple, is solely responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app, and in the event of a failure to conform to a warranty, you may notify Apple, which will refund the purchase price (if any) of the app; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing claims relating to the app or your use of it, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you once you accept them.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Lakso on Apple devices you own or control, as permitted by the App Store usage rules, and only for your own non-commercial budgeting. You may not copy, modify, reverse engineer, decompile or disassemble the app (except where the law allows it despite this restriction), remove any notices, or use the app to build a competing product or service. All rights not expressly granted remain with Silsoft Studio.

3. Subscription

Plans. Some or all features of Lakso require an auto-renewing subscription, offered monthly or yearly. The price, billing period and any free trial are shown on the purchase screen before you subscribe, in your local currency, and can differ by country.
Free trial. If we offer a free trial, you are not charged until it ends. Unless you cancel at least 24 hours before the trial ends, the subscription renews automatically and your Apple ID account is charged the price shown. Any unused part of a free trial is forfeited when you purchase a subscription.
Payment and renewal. Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
Managing and cancelling. You can manage or cancel your subscription at any time in your device's Settings → [your name] → Subscriptions (or from Lakso's Settings). Deleting the app does not cancel the subscription. Cancelling stops future renewals; you keep access until the end of the period you already paid for.
Refunds. Payments are handled by Apple, not by us. Requests for refunds are decided by Apple under its policies (https://reportaproblem.apple.com). Nothing here limits any mandatory consumer rights you have under the law of your country, including statutory rights of withdrawal.
Price changes. If we change the price of a subscription, Apple will notify you and, where required by law, ask for your consent before the new price applies to you.
Without a subscription. If your subscription ends, you keep access to your data: you can still view your history, export it, and delete it, as described in the app. Some features that create or change budget data may be unavailable until you subscribe again.

4. Your data

The budget information you enter in Lakso is yours. It is stored on your devices (and in your private iCloud account if you turn on the optional iCloud backup), as explained in our Privacy Policy. You are responsible for keeping your device secure and for backing up your data. If you erase the app or its data, or lose your device without a backup, we cannot recover it for you.

5. Not financial advice

Lakso is a budgeting tool. It does calculations from the numbers you give it and shows suggestions, such as how much you can spend per day. It is not financial, tax, legal or investment advice, and we are not a bank, financial institution or advisor. Results depend on the accuracy of what you enter. Decisions about your money are your own responsibility, and you should seek professional advice where appropriate.

6. Acceptable use

You agree not to misuse the app: not to use it unlawfully, interfere with or attempt to bypass its security or subscription checks, or share access in ways that violate the App Store rules. Features such as the Apple Pay shortcut rely on Apple's services and your own configuration, and you must set them up yourself.

7. Updates and availability

We may update, change or discontinue features of Lakso, and releases may require a recent version of iOS or watchOS. We do not guarantee that the app will be uninterrupted or error-free, and widgets, the Apple Watch app and shortcuts may update later than the main app because of how the operating systems schedule them. Apple has no obligation to provide support for the app. For support, contact us at dev.apps@silsoftstudio.com.

8. Disclaimer of warranties

To the fullest extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. Nothing in these Terms excludes or limits warranties or rights that cannot be excluded under applicable mandatory law, including consumer protection law.

9. Limitation of liability

To the fullest extent permitted by law, Silsoft Studio is not liable for indirect, incidental, special or consequential damages, or for loss of data, profit or opportunity, arising from your use of or inability to use the app, including any financial decisions you make using it. Our total liability to you for any claim related to the app is limited to the amount you paid for the app or subscription in the 12 months before the claim arose. This does not limit liability for intent or gross negligence, or any liability that cannot be limited under applicable law.

10. Intellectual property

The app, its design, text, code, name and logo are owned by Silsoft Studio AS or its licensors and are protected by copyright and other laws. "Lakso" is our name; you may not use it without our written permission. If you send us feedback or ideas, you allow us to use them to improve the app without obligation to you.

11. Termination

These Terms last as long as you use the app. We may suspend or end your licence if you materially breach these Terms. You may end it at any time by deleting the app (and cancelling any subscription, see section 3). Sections that by their nature should survive termination, such as sections 5, 8, 9, 10 and 12, do.

12. Governing law and disputes

These Terms are governed by Norwegian law, without regard to its conflict-of-law rules. Any dispute is subject to the jurisdiction of the Norwegian courts. If you are a consumer, this does not take away any mandatory rights or protections you have under the law of the country where you live, or your right to bring a claim in your local courts if that law gives you that right. Consumers in the EU/EEA may also use the European Commission's online dispute resolution platform and Norwegian consumer bodies, such as the Consumer Authority (Forbrukertilsynet).

13. Changes to these Terms

We may update these Terms. If we make a material change, we will notify you in the app or by updating the date above, and the new Terms apply from then on if you keep using the app. If you do not agree, stop using the app and cancel your subscription.
